Terms & Conditions
Plain English, no fine-print games. These terms cover using this website and working with Demand Hive. The specific numbers for your plan live in your signed Services Agreement and Order Form — this page is the general framework.
1. Who we are & agreeing to these terms
This site is operated by Demand Hive LLC ("Demand Hive," "we," "us"), based in San Diego, California. By using this website, booking a call, or becoming a client, you agree to these Terms. If you don't agree, please don't use the site or services.
2. What we do
Demand Hive builds and runs marketing and automation systems for local service businesses — including an AI phone assistant ("AI caller"), missed-call text-back, online booking and reminders, websites, review automation, and related marketing. The AI caller is positioned as a filter and helper, not a replacement for you. It's software: it works hard and answers most calls well, but it is not a flawless human and we don't promise it never mis-answers.
3. Booking & communications
When you give us your number or email — by booking a call, filling out a form, or reaching out — you agree we may contact you by phone, text, and email about your inquiry and any services you ask about. You can opt out of non-essential messages anytime (reply STOP to texts, or email us).
4. Fees, billing & subscriptions
Paid services are billed to the card on file through our payment processor. One-time setup/build fees are charged up front; monthly plans bill in advance, automatically, so there are no invoices to chase. You can cancel anytime with the notice stated in your agreement (typically 14 days) — no long-term lock-in. Late or failed payments may pause your services until resolved.
5. Usage & overage charges — read this part
The AI caller, missed-call text-back, and SMS features use live phone minutes and text messages that cost real money each time they run (phone carrier + AI costs). To keep your base price low, your monthly plan includes a usage allowance, and anything beyond it is billed as usage. This means you only pay for the extra volume you actually drive.
- Your plan includes a set monthly allowance of AI call talk-time, text-message segments, and phone number(s). The exact allowances and per-unit overage rates for your plan are listed in your Order Form / Services Agreement.
- Overages are tallied monthly and added to your next bill, itemized so you can see exactly what ran.
- Our heads-up promise: if your usage trends toward roughly twice your included allowance in a month, we'll flag it to you before billing — so there are never surprises.
- Usage/overage rates can change with 30 days' written notice (for example, if carrier costs rise). Your base plan price stays fixed for the current term.
6. Your responsibilities & messaging compliance
You agree to use the services lawfully. For any texting or outbound marketing sent on your behalf, you are the sender of record and are responsible for having proper consent from the people you contact and for complying with applicable laws — including the TCPA, A2P 10DLC registration, state telemarketing rules, and Do-Not-Call requirements. We set up and maintain the tools; you warrant you have the right to contact your own contacts.
7. Call recording & transcription
The AI caller may record and transcribe calls in order to function (to understand callers, capture details, and hand you a call log). By using the service you consent to this, and you're responsible for any caller-notification your state requires (for example, an "this call may be recorded" notice). We handle call data reasonably and only to deliver the service.
8. Ownership
Once you've paid in full, you own your website content and your customer/call data. Demand Hive keeps ownership of its underlying systems, templates, automations, and platform (GHL/LeadConnector) sub-account configuration, which are licensed to you for as long as you're a client. On cancellation, you can request a reasonable export of your site content and call data.
9. No guarantee of results
We provide tools and setup in good faith and work hard to get you results. We do not guarantee any specific number of leads, bookings, sales, call-answer accuracy, or revenue. Outcomes depend on many things outside our control.
10. Limitation of liability
To the maximum extent allowed by law, Demand Hive's total liability under our agreement is limited to the amount you paid us in the three months before a claim. Neither party is liable for indirect or consequential damages. We're not responsible for third-party outages (phone carriers, GHL/LeadConnector, hosting, Google) or for your own compliance obligations under Section 6.
11. Cancellation & refunds
Service is month-to-month unless your agreement says otherwise. Either side can cancel with the notice in your agreement; recurring billing stops at the end of the current paid period and any outstanding usage is billed. One-time setup fees are refundable only if we haven't started build work yet. Monthly fees already billed aren't refundable, but you can stop future billing anytime.
12. Changes to these terms
We may update these Terms from time to time. The "last updated" date at the top shows the current version. Continuing to use the site or services after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of California. If any part is unenforceable, the rest still stands. Your signed Services Agreement, where one exists, controls if anything here conflicts with it.
